Terms of Use
Summary
This document describes current Terms of Use policy for accessing and purchasing items from NuGadgets, whether the purchase is made online, over the phone or in any other manner. Please be aware that by purchasing from NuGadgets you explicitly agree to abide by every stated term in this document as well as our Return Policy and Shipping policy. Please read and print out for future reference the documents available at the time of sale as these may be changed or modified from time to time without notice.
Typographical Errors
All Prices, images and specifications are subject to change without notice. NuGadgets does its best to be accurate, but occasionally clerical or other mistakes may occur. NuGadgets provides all product information accurately, to the best of its abilities and knowledge and is not responsible for typographical errors, incorrect images, product descriptions and specifications. NuGadgets will make corrections to any provided information once it becomes available. In the unlikely event a product is listed at an incorrect price, NuGadgets shall reserve the right to refuse or cancel any orders placed for such item. Incorrect image, specification or description does not qualify a product as mis-shipped, unless the manufacturer’s part number does not match the product that was received. NuGadgets product details page can not be considered the sole source for getting product information and therefore will not cause liability on the part of NuGadgets. Customer will assume all risk associated with purchasing a product and is strongly advised to research all of the product information based on the manufacturer part number. It is strongly suggested that customer contact manufacturer’s support team or visit the official manufacturer web site for complete information on a product prior to the purchase.
Site Use
Your use of this site and submittal of any purchase indicates your acceptance of the terms and conditions. NuGadgets reserves the right to make changes to this site and these terms and conditions at any time and without notice. If you do not agree with the User Agreement, please do not use this site. NuGadgets makes no representation that materials on this site are appropriate or available for use in other locations, and access to them from territories where their contents are illegal or not authorized. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. Any claim relating to, and the use of, this site and the materials contained herein is governed by the laws of the state of Illinois without regard to conflict of law rules.
NuGadgets shall not be held liable for any failure to perform or delay in performing any of its obligations when such failure or delay is due to circumstances beyond its reasonable control including, without limitations, any act of God, war, strike, riot, fire, flood, earthquake, lock-out, late or non-delivery by suppliers, shortage or unavailability of materials, components or transportation facilities, or act, refusal to act, regulation, order or intervention of any governmental authority. NuGadgets makes no representations or warranties of any kind with respect to products sold by NuGadgets. Except as expressly stated herein, NuGadgets disclaims all warranties expressed or implied, of any kind with respect to products sold on this site, including but not limited to merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to NuGadgets arising from any product sold shall be the price of the product ordered. In no event shall NuGadgets be liable for special, indirect, consequential, or punitive damages related to product sold.
Order Acceptance Policy
Your receipt of an electronic order confirmation does not signify our acceptance of your order. NuGadgets reserves the right at any time after receipt of your order, to either accept or decline your order for any reason. NuGadgets reserves the right, without prior notice, to supply less than the quantity of any item ordered. All orders are subject to credit approval, and all items are limited to supply on hand. Customer is responsible for paying any freight charge and restocking fee caused by refused shipment or unclaimed goods.
It is customer's responsibility to verify accuracy and completeness of an order by reviewing order confirmation e-mail. NuGadgets is not responsible for non-receipt of communication e-mails due to incorrectly entered email address, spam block or any other e-mail failures. If you do not receive an order confirmation email within 1 hour of placing the order, please contact our customer service to make us aware of the problem and to verify validity of the email address on file.
Order Cancellation Policy
Customer may cancel an Order up until a notification of order processing is sent via email or if the product is in “back-order” status. Once the order has physically shipped, in-part or in-full, it is considered as fulfilled and is subject to an applicable re-stocking fee. To request order cancellation, please contact Customer Service via email or by phone. Order is not considered Cancelled until you receive a notification that states that we have been able to stop the order. Special Orders may not be cancelled once the order has been accepted and charged for.
Payment Methods
We currently accept US and Canadian Bank-issued MasterCard, VISA, American Express and Discover credit card payments. Please be sure to provide your complete and exact billing address and telephone number that matches the one your credit card company has on file for your account. Incorrect information as well as ship-to address different from billing may cause a delay in processing your order. Please read our credit card policy. In some cases we may accept Business or Government Purchase Orders payable with a Wire Transfer or a Company check if Net terms have been established. Please contact Customer Service for more information.
Shipping Policy
All credit card orders for “in-stock” products placed by 2 PM CST (US Central Standard Time) on any business day are normally shipped within 1-2 business days upon payment approval. All orders received after 2:00 PM CST are considered received on the following business day. We do not ship items on weekends or regular bank holidays. No items will be delivered on weekends or holidays. If there are any anticipated delays in shipping your order, you may be contacted by our Customer Service representative via e-mail or by phone, with options of accepting the order at an estimated date or canceling for a refund of the item backordered.
Estimated time of delivery for “Ground” shipping is 4 to 10 business days, depending on ship-to location. If tracking information is available, it will be included in shipping notification e-mail. Tracking number may also be found by accessing your Account’s Order page on our Web site.
“Free Ground Shipping” products may take 7 -10 business days to be delivered and may not have a tracking number available.
NuGadgets reserves the right to change freight carriers and shipping methods for your order without prior notice. Expedited orders will be delivered by any method of NuGadgets choosing and is guaranteed to be delivered on or before the chosen delivery date.
Taxes and duties
NuGadgets must charge Sales Tax on any orders shipped to addresses within the state of Illinois. Each customer shall be responsible for any fees and taxes required by the locality where the product is shipped.
Recent changes in interstate commerce require us to charge sales taxes in California and Tennessee for certain Computer products. If these taxes are applicable, you will see an additional Sales Tax charge at the time of the checkout. Please contact Customer Service to see if your product will be charged a sales tax.
Canadian Customs and Brokerage Fees
Any customs fees and duties for all Canadian orders are the responsibility of the customer. NuGadgets ships all orders as purchases and never as gifts. Currently, NuGadgets uses United Parcel Service (UPS) freight carrier for most shipments to Canada. Please be aware that aside from the regular duties, UPS charges a brokerage fee for deliveries to Canadian destinations. These are determined and charged directly by UPS and are not included in the shipping/handling fee charged by NuGadgets. Damaged Shipments
For your protection, NuGadgets purchases excess value coverage from the various Interstate Common Carriers that we employ to ensure that the merchandise you ordered arrives undamaged. The charge for this coverage is included in the handling fees that we charge.
In the unlikely event that your shipment arrives with physical damage or shortage:
- Advise the carrier’s representative that there is physical damage (or a shortage) and note the damage (or a shortage) on the “airbill” (all damage must be stated on the “airbill”).
- No damage/shortage claims are accepted AFTER the delivery has been made.
- Do NOT sign the “airbill” stating that the merchandise was received in Good Condition, unless you agree that it is so.
- Retain all shipping materials.
- Notify our Customer Service as soon as possible.
- A representative of the Interstate Common Carrier will contact you to make arrangements for viewing and assessing the damages.
Warranty
All of NuGadgets products shipped to US and Canada are guaranteed against manufacturer defects for 21 days from the date of invoice. Warranty is voided without receipt or invoice. Refer to Return Policy for warranty claim procedure.
Panasonic Fax Machines, DVD Players, VCR’s, Camcorders and Digital Cameras and other non-returnable products must be returned/exchanged directly through the manufacturer for repair or replacement.
There is no warranty for physically damaged items, which have cracks, missing pins, or burn marks. Any items found to be abused, misused, mishandled, modified or altered, damaged by power surges, floods, brownouts, or other natural disasters are not covered by manufacturer warranty. Warranty sticker and serial numbers must be intact on all merchandise.
Repaired or replaced RMA items carry the original warranty of the product. If a replacement is not available, NuGadgets reserves the right to repair the products, replace with similar products of equal or greater value or offer upgraded products at a minimum fee, if the item has been discontinued from our product line. NuGadgets accepts no liability with respect to any software or data contained in any products or parts sold by or returned to NuGadgets. We do not offer cross shipping. A replacement will be shipped via UPS Ground or US Mail within 12-15 business days after the returned item is received. If replacement item is not available at that time, credit of same value will be issued to your account. Express shipping is available at additional cost.
